Welcome to **Custom Pitch Academy** ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our services, including in-person and online coaching sessions, content, and website located at www.custompitchacademy.com ("Services"). By using our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you should not use our Services.

 

1. Services Provided
Custom Pitch Academy offers personalized pitching lessons, designed to help pitchers of all ages and skill levels, from youth to college athletes. Lessons may be conducted in-person or virtually, and additional resources such as video analysis, training tools, and progress reports may be provided as part of the Service.

In addition to lessons, Custom Pitch Academy publishes **blogs, articles, and other materials** from both our instructors and other recognized experts in the field of baseball and pitching. These materials are provided **free of charge** and are available for educational purposes. Users may freely reference, share, or utilize these materials, provided proper credit is given where applicable. These materials are offered as a resource to enhance understanding of pitching techniques and baseball development.

 

2. Payment and Fees
The cost per session is $85 per hour. Payment is required in advance for all lessons and can be made in cash or via Venmo. Failure to make timely payments may result in the suspension or termination of Services.

 

3. Cancellation and Refund Policy
Cancellations must be made at least 24 hours in advance. Failure to cancel within this time frame will result in the loss of the session, and no refund will be issued.

 

4. Waiver and Liability
By participating in any pitching lessons or using any training tools or facilities provided by Custom Pitch Academy, you acknowledge that baseball training, particularly pitching, involves physical activity that carries certain risks. You agree to waive any liability claims against Custom Pitch Academy, its instructors, employees, or agents for any injuries or damages that may occur during your training.

Parents or guardians of minor participants must sign a waiver acknowledging and accepting these risks.

 

5. Use of Media
By enrolling in Custom Pitch Academy, you consent to the use of pictures and videos of you (or your child) for the purpose of coaching, marketing, and promotional materials. These images may be displayed on our website, social media, or other advertising platforms. You may opt out by notifying us in writing at michael.richard@custompitchacademy.com.

 

6. Code of Conduct
All participants are expected to behave respectfully and professionally during lessons. Disruptive behavior may result in termination of lessons without refund.

 

7. Intellectual Property
All content provided through Custom Pitch Academy, including training materials, videos, and digital resources, is the intellectual property of Custom Pitch Academy. You may not reproduce, distribute, or share any materials without prior written permission, except for blog posts and articles from third-party experts, which may be freely shared with proper attribution.

 

8. Changes to the Terms
Custom Pitch Academy reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services following any changes constitutes your acceptance of the new Terms.

 

9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state of Maryland, without regard to its conflict of law provisions.
